Packing #SCOTUS has become a Washington power struggle that will continue for years. It was the most partisan confirmation vote for a Supreme Court justice in modern American history and the first time since 1869 that justice was confirmed without a single vote from the opposing party.
The US Constitution allows Congress to determine how many justices should make up the SCOTUS. That number has ranged from 6 to 10, before settling at 9. If they win control, Democrats can now expand the number to remedy GOP court-packing.
POTUS has made big changes to the federal judiciary since taking office, appointing three Supreme Court justices, as well as nearly 200 other judges for their lifetime to lower federal courts.
As soon as it became clear that the Republican-controlled Senate would confirm Judge Amy Coney Barrett, creating a 6-3 conservative majority on the court, Democrats argued that they should increase the number of Supreme Court Justices.
The Republicans are packing the courts and continue the practice for SCOTUS. This last hurrah is a historic final straw since1869. The GOP is insisting on packing the court without bipartisan support regardless of historic precedent.
The Constitution left it to Congress to decide how many justices should make up the Supreme Court. Democrats have the right to expand the court if they think that’s the best way to remedy GOP court-packing.
