Former special counsel Jack Smith testified before the Senate Judiciary Committee about his office obtaining phone records belonging to Republican lawmakers as part of its investigations into President Trump's alleged election interference and alleged mishandling of classified documents. 

Smith said the records obtained were "non-content" toll records and argued that accessing the data was relevant to his investigations for legitimate investigative purposes. He also emphasized that no wiretapping occurred. He said, "I stand by my decisions as special counsel, including my decision to bring charges against President Trump. I made those decisions without regard to President Trump's political association. … 

Our investigation developed proof beyond a reasonable doubt that President Trump engaged in serious crimes against our nation." Smith also addressed the prospect of prosecution, saying, "I will not be silenced by continued threats of prosecution from the president or others
