DEAR JUAN

The judge in former Pres. Trump's criminal hush money case has delayed his sentencing until November 26 weeks after Election Day.

Donald Trump was found guilty in May on 34 felony counts of falsifying business records related to a hush money payment to adult film actress Stormy Daniels in order to boost his electoral prospects in the 2016 presidential election.

Dear Justice Juan Merchan, if you’re listening please add a mandatory psychiatric evaluation of the former guy to his criminal sentence.

Merchan is an acting justice of the New York State Supreme Court in Manhattan. He presided over the 2024 criminal trial of former US president Donald Trump, in which Trump was convicted. Merchan is the first judge in history to preside over the criminal indictment and conviction of a US President, and the first judge to hold a President in criminal contempt of court.

A psychiatric evaluation, also known as a psychological screening or assessment, is a process that involves gathering information about a person's mental health to make a diagnosis. The evaluation is usually the first step in treatment, but it can also be used for legal purposes.

During a psychiatric evaluation, a psychiatrist or other mental health professional will examine a patient's mental and emotional well-being. The evaluation may include:

  • A medical history and physical exam, including a review of past medical records

  • A mental status exam, which assesses a patient's thoughts, feelings, and behaviors
  • A review of family history for genetic factors
  • An assessment of social history, including education, employment, relationships, and substance use patterns
  • Questions about traumatic events, childhood, and religious beliefs

The evaluation may help identify mental health issues and determine the best course of treatment.

Justice Juan M. Merchan has tried to treat the former guy like the hundreds of other defendants whose fates he has decided. However this decision alters American history.

Judge Merchan shouldn’t delay Trump’s New York sentencing. There is no basis for another delay under the law.
