Real Crimes or Misdemeanors?

Crossing the US border without permission is a misdemeanor. The connection between immigration and crime is one of the most confusing and contentious topics in modern day society. Debates on the issue date back more than 100 years. A general point on which both pro- and anti-immigration scholars agree on is that the latest wave of immigration is likely to have a more impact on American politics than any other socially charged issue.

Under US law, it is a crime for anyone to enter without the approval of an immigration officer. This is a misdemeanor offense that carries fines and no more than six months in prison.

Many foreign nationals enter legally every day on valid work or travel visas and end up overstaying for a variety of reasons.
But that's not a violation of federal criminal law it's a civil violation that gets handled in immigration court proceedings.

Whether it's by crossing the USA border with a coyote or buying the fake documents, these are considered misdemeanors under federal law (18 U.S.C.A. § 3559).

A misdemeanor is a lesser criminal act in some common law legal systems that are generally punished less severely than felonies, but theoretically more so than administrative infractions and regulatory offenses.
